OFFICIAL CONTEST RULES
1. Eligibility - Blue Havana II Cigars Millionth Cigar Contest ("Contest") is open to all existing customers of Blue Havana II Cigars involved in face-to-face transactions. You must be 21 or older to enter. Employees and suppliers are ineligible to participate.
2. Sponsorship - The sole sponsor of the Contest is Blue Havana II LLC ("Sponsor"), 6320 Atlanta Hwy #8, Alpharetta, GA 30004.
3. Agreement to Rules - Participants agree to abide by the Sponsor’s Official Rules and decisions. The Sponsor has the right to refuse, withdraw, or disqualify entries at its' sole discretion. The participant agrees to accept the decision of the Sponsor as final and binding.
4. Entry Period - Entries into this Contest will be accepted beginning January 1, 2023. No entries will be accepted after June 30, 2023.
5. How to Enter -
- All entries must be submitted by completing the online form.
- One Contest entry per customer. If multiple entries are made, only the first guess will count.
- Eligibility will be verified through the Sponsor's Customer Database. The Sponsor will invalidate any ineligible participant's entry.
6. Prizes - A single Grand Prize of "Free Cigars For A Year" will be awarded. "Free Cigars For A Year" is defined as ten dollars ($10) off a cigar purchase exceeding that amount (per FDA law) each week for fifty-two (52) consecutive weeks beginning the first of the month following the conclusion of the Contest. All the Sponsor does not ship, the prize is redeemable only through a face-to-face transaction. Unused weeks do not carry over. Maximum prize retail value is $520.00 and is not transferable. Acceptance of the prize grants the Sponsor permission to use the Winners entry, name, and likeness for advertising, promotion, and trade without further compensation or remuneration unless prohibited by law.
7. Odds - Odds of winning is dependent upon the number of eligible entries received.
8. Selection and Notification of the Winner - The winner will be determined by the entry who has guessed closest to the date and time that the Sponsor has declared the millionth cigar sold. In the event of a tie, the entry with the earliest entry date and time will be declared the winner. The winner will be notified by email and/or telephone. The Sponsor will not be liable for the winner’s failure to receive notification of winning if he or she provided a wrong email address or incorrect phone number or if their email security settings caused the prize notification to go into the spam or junk folder.
9. Rights Granted by the Entrant - All participants grant the right to use the their submission, voice, likeness, image, statements about the Contest, etc., for publicity, news, advertising, promotional purposes, trade, and so forth, without any further notice, review, consent, compensation or remuneration.
10. Terms & Conditions - The Sponsor reserves the right to modify, suspend, cancel or terminate in the event that non-authorized human intervention, a bug or virus, fraud, or other causes beyond our control impact or corrupt the security, fairness, proper conduct, or administration of the Contest. The Sponsor reserves the right to disqualify anyone who violates the terms, as well as the right to seek damages to the fullest extent permitted by law in cases where a participant has caused deliberate damage or undermined the legal operation of this Contest.
11. Limitation of Liability - Entry into the Contest constitutes agreement to release and hold harmless the Sponsor and its subsidiaries, affiliates, employees, etc., against all claims liability, illness, injury, death, loss, etc., that occurs directly or indirectly from participation in the Contest or use/misuse of the awarded prize.
12. Disputes - The entrant agrees, as a condition of participating in the Contest, that disputes not resolved between the participant and Sponsor shall be individually resolved exclusively before a court located in the State of Georgia, without resorting to any form of class action. Entrants waive all rights to punitive, incidental, or consequential damages, and they waive all rights to have damages multiplied or increased.
13. Privacy Policy - Committed to privacy, the Sponsor will not share any email or contact information with any outside party.
14. Winners List - Participants may request the copy of the winners list by emailing their request to bluehavana@bellsouth.net.
15. Social Media Platform Rules - The Contest hosted by Blue Havana II LLC is in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, Twitter or any other person or entity.
16. Affirmation of Acceptance of and Agreement to All of the Official Rules - By entering the Contest, the entrant has reviewed, accepted, and agrees to all of the Official Rules of this Contest.
